一、近年来我市政府采购基本情况

(一)机构及制度建设情况

我市政府采购工作是从1997年开始试点。20_年市级成立政府采购监督管理部门。20_年5月19日，市政府通过《遵义市政府采购管理暂行办法》，成立了市级政府采购中心，为非营利的事业法人，财政全额拨款事业单位，隶属市政府办，主要负责市本级政府集中采购项目，市级实现了政府采购的管采分离。到今年，我市14个县(区、市)均相继成立了专门的政府采购监督管理机构，有10个县(区、市)成立了政府采购中心，并配备3-4人负责此项工作。

从20_年开始政府采购以来，先后制定出台了《关于进一步加强政府采购工作的意见》《遵义市政府采购管理暂行制度》《进一步加强政府采购资金财政直接支付管理的通知》《关于做好市级政府采购分散采购工作的通知》等管理制度，在信息公告、专家评审等方面出台了规范性文件，进一步细化了政府采购法的规定，明确了政府采购的程序、方法和部门职责，强化了政府采购的监管，确保各采购工作环节有章可循，为全面推进我市政府采购工作提供了制度保障。

(二)政府采购执行情况

几年来，全市基本形成了政府采购预算管理、采购项目实施和资金支付有机衔接的管理体系，并逐渐形成了以政府集中采购为主，部门集中采购为辅，分散采购为补充的采购模式，基本覆盖了货物、服务、和工程三大类，货物类主要集中在计算机网络、空调、车辆、医疗设备等。可以说在加强财政支出管理、深化财政体制改革、提高财政资金使用效益、发挥宏观调控作用、促进廉政建设方面达到了预期效果。从20_年以来，全市执行采购预算亿元，实际支付采购资金亿元，共节约资金12265万元，资金节约率为。其中20_年全市节约资金万元，20_年全市节约资金万元，20_全市节约资金3798万元。其中市政府采购中心共组织了124次采购，执行采购预算万元，实际采购资金万元，节约资金万元，节约率为。

二、当前政府采购中存在的主要问题

(一)预算的编制的问题。有些单位不重视政府采购预算，

一是没有把预算细化到具体项目上，预算刚性不强，直接导致了采购的随意性。单位编制预算时只编大体系分类和项目的数目，保持_灵活_，给采购意愿的变化留_后路_。这种做法就从根本上影响了政府采购工作的顺利进行，政府采购的规模效益和高效快捷也无从说起。二是预算不科学，对采购项目不进行科学的认证，不进行充分的市场调研，采购预算的编制不是过高就是过低，特别是有些专项资金在编制预算时还没有项目实施计划，预算编制存在采购标准不统一、政府采购预算与实际采购相脱节等情况。致使采购受到人为因素的影响，难于操作，增加采购成本，降低采购效率。三是采购预算编制不科学不细化，特别是节约资金归属的问题。目前我市节约资金是划归采购单位，这让采购单位在编制采购预算时有甜头，反正节约资金归自已单位，何不如把预算编高一点，倒致最后形成的节约力和节约资金大打折扣。从某种角度来讲，这也是造成采购预算编制不精细不规范不科学原因之一。

(二)政府采购的规模较小，项目单一。从近年的采购情况看，采购范围主要是通用类项目的货物类产品上，工程和服务类较少，虽然医疗设备，教学设备、物业管理也有采购，但规模相对小。采购规模小的原因有：一是统计数据没有做到应统尽统计，致使规模没能全面反映，二是存在规避采购的情况，没有做到应采尽采，如车辆的加油与维修没通过政府采购，三是采购随意性较大，零星采购的数量与金额小，对供应商投标也缺乏吸引力，采购成本增加，规模效益很难体现出来。

(三)评审专家库的问题。专家资源是政府采购工作非常重要的基础资源，组织评标、技术咨询、投诉质疑处理等都离不开专家资源的支撑。目前我市专家库存在种类单一、数量少、更新慢的情况，有些类别的专家如图书类、软件类专家很少，仅有两三名。按相关规定专家库实行动态管理，我们虽然对专家库也在陆续的完善充实，但实际情况还是不能满足目前采购工作的需要，有些采购项目的专家只有前往省财政厅抽取，增加了成本，在一定程度上严重的影响了政府采购工作。

(四)政府采购业务代理的问题。一是社会中介代理机构代理在管理和硬件软件上存在一些问题，在开标厅设施、公告发布、档案管理的问题上尤为突出。二是中介机构普遍反映政府采购业务代理得很少，三年来都没超过一千万，没有积极的参与进来，没有形成有效的竞争。

(五)机构和制度不健全。虽然我市大部分县已成立了采购中心，在机构上实现了_管采分离_，但还存在即当裁判员又当运动员的情况，每次开标，谈判、询价财政部门的人员都在陪同参与采购活动。另外，由于相应的法规缺少实施细则和相关的配套制度，县级监管执行中还存在一些政策的空白点。如对于集中采购与非集中采购、对于什么是部门集中采购、部门集中采购是否需要委托集中采购代理采购，缺乏明确规定，给实际的监管带来难度。

(六)公务用车运行管理很不规范。单位普遍反映，现在机关事业单位的公务用车运行管理很不规范。对公务用车的维护保障、运行管理很难，如车辆的维修，加油的等方面出现诸多问题，车辆的定点保险从20_年通过政府采购以来一直没有再进行重新招标。

(七)干部队伍建设的问题。采购工作涉及面比较广，专业化水平要求高。政府采购工作客观上要求工作人员不仅要懂得政策法规，财经方面的知识，而且还要掌握分析市场信息，市场操作上的一些技能，熟悉产品的性能价格，特别是网络工程方面的知识。而从社会的发展来和从事采购工作人员的素质看，业务水平和依法行政和能力还有待于进一步加强。

三、规范政府采购工作的建议意见

(一)摸清家底，强化预算管理，发挥政府采购规模效应。一是各单位要与资产管理相结合摸清家底，可避免无预算采购、重复购置、盲目购置等浪费行为，以不浪费、不奢侈、重效益为目的。并在编制政府采购预算时，要结合本单位现有的资产情况，资源共享，避免重复浪费。二是强化预算约束力，对未编入政府采购预算的采购项目，原则上当年不能采购。确需追加的采购支出，必须按法定程序报批。对规避采购，随意分解、肢解采购的行为，相关部门要有切实可行的处罚制度。

(二)对采购项目进行科学论证。具体指单位是否需要实施采购、采购项目相关技术规格、服务要求等应当做前期论证，这样可避免不合理的过高的技术配置，出现高配低用，造成资源的闲置和浪费，过低的技术配置也不能达到实际使用功能要求，因此合理的科学的采购需求论证很有必要。

(三)加快电子化政府采购平台的建设。电子化政府平台正在建设中，通过平台建设，实行协议供货或网上竞价采购，既较好地解决了采购通用类货物和服务中零星采购、小额采购和急需采购的效率与效益的矛盾，同时在一定程度上达到了将零星小额采购集中增加采购规模效应的目的，提高采购效率。

(四)把政府采购节约资金上缴国库。财政部关于《政府采购资金财政直接拨付管理暂行办》(财库[20_]21号)第十五条的规定办理，即政府采购节约的资金,属于预算资金的原则上留在银行国库平衡预算。预算外资金及单位自筹资金按各自负担比例原渠道划还采购机关。同时还规定，政府采购节约资金的具体处理办法由省级财政部门确定。预算外资金现在已纳入预算管理，目前我省只有针对省级部门的规定，对于我们地州市没有相关的具体的实施细则，目前的操作是节约资金划回采购单位，从某种角度来讲，这不利于采购采购预算的科学细化编制，这也是造成采购预算编制不精细不规范不科学原因之一。

(五)实行车辆定点加油、定点维修制度。为规范公务车辆的管理，节约财政资金，建议市直单位的车辆加油，维修通过政府采购来集中采购，对于车辆保险，我市在20_年通过政府采购确定了一家保险公司，原则上是一年一招标，为了提高服务质量，促进公平竞争，保险标准也在更新，建议车辆保险也顺应市场的变化重新进行招标确定一至两家保险单位来进行车辆的保险。

(六)合理编制我市政府采购目录。依据省级的相关规定针对现在的工作实际，制定出我市政府采购目录。

(七)整合专家库，建立政府采购评审专家资源共享制度。建议把两城区的专家充实到市级的专家库，整合市级专家库资源，从而达到资源共享的目的。加强专家库的动态管理，同时对评审专家进行培训，提高专家的政策和业务水平。

(八)进一步健全采管分离制度。管采分离是要求政府采购监督管理机构与操作执行机构在机构、职责、人员等方面要分开。各级财政局主要是负责监督管理和政策法规的宣传，审核预算，确定方式，监管资金运行等程序上的工作，而政府采购代理机构是执行机构，不是每次开标评标、询价采购财政部门的人员都要随同前往。

(九)充分利用社会中介机构强化市场竞争。让中介机构参与到政府采购工作中来，通过竞争找差距来激发竞争活力，充分挖掘采购代理机构工作效能，寻找采购代理采购工作方面存在的差距，有效激发代理采购机构的主动性与积极性，激发采购机构之间的竞争活力，对促进政府采购工作有很大的好处。

(十)加大干部培训力度，提高工作水平。一是对采购工作人员的培训，再就是评审专家的培训。培训内容为政府采购、招标投标的相关政策法规和业务理论知识。采取走出去或请进来的方式、定期与不定期的培训或座谈的形式进行学习培训。加强作风建设，强化服务意识，努力提高办事效率。
